Terms of Use

Last updated 9 October 2026. These terms apply to everyone who uses smousplek.co.za and the SmousPlek app (“the platform”). By using the platform or posting an ad you agree to them.

Clauses printed in bold limit our liability, place risk on you, or create obligations for you. Please read them carefully (Consumer Protection Act 68 of 2008, section 49).

1. Who we are

The platform is operated by Lenro Mostert t/a SmousPlek (“SmousPlek”, “we”). Our full details are in the Legal Notice.

2. What SmousPlek does

SmousPlek is an online classifieds platform. We publish ads placed by users so that buyers and sellers can find each other. We are not a party to any sale, lease, service or other agreement between users. We do not own, inspect, store, deliver or guarantee any item, and we do not act as agent for any user.

3. Accounts

  • You must be 18 or older and able to enter into a binding contract.
  • You must give accurate details and confirm your cellphone number by SMS.
  • You are responsible for everything done through your account. Keep your password and codes private.

4. Posting an ad

  • Prices depend on what you advertise. They are shown on the Pricing page and again before you publish, and include VAT where applicable. Prices may change, but never for an ad you have already paid for.
    • Everyday items (home & garden, fashion, baby & kids, phones & electronics, sport, hobbies, pets, vehicle parts and everything else): a free basic ad for 30 days. Up to 3 free ads may be live at a time per account and cellphone number; each further ad costs R29.
    • Community and events, swap and give away, and people looking for work: free, up to 10 live at a time.
    • Vehicles: R149 for 30 days or R249 for 90 days. Property for sale: R299 for 90 days or R499 for 180 days. Property to rent and rooms: R149 for 30 days or R249 for 60 days. Job openings: R99 for 30 days. Services, farming, solar and business: R99 for 30 days or R249 for 90 days.
  • Choose the category that honestly fits your ad. We may move an ad to the correct category, or remove it without a refund, if it was placed in another category to avoid the correct price. Once an ad has been published, it cannot be moved to a category with a different price; post a new ad instead.
  • First ad free. Each new seller’s first paid ad is free, for whichever duration they choose. It is counted once per account and per cellphone number.
  • Renewals. Renewing a paid ad costs 25% less than the normal price.
  • Free extension. If a paid ad that runs for 30 days or longer receives fewer than 3 requests to show the seller’s contact details in its first 14 days, we add 14 days to it free of charge, once per ad. This is an extension, not a refund.
  • Boosts. Optional boosts (bump to the top R19, featured for 7 days R39, urgent label for 14 days R19) start as soon as they are applied, and are not refunded if the ad is later removed, sold or expires.
  • Credit. Credit bought in packs or earned through referrals can be used only on SmousPlek for ads, renewals and boosts. It is valid for at least 3 years from the date it is added (Consumer Protection Act, section 63), cannot be exchanged for cash or transferred to someone else, and is refunded only as set out in our refund policy or where the law requires. Please use or ask us about unused credit before you delete your account.
  • Referrals. You earn R20 credit when someone signs up through your invite link and publishes their first ad. It is earned once per new seller, not for your own other accounts or anyone using your cellphone number. We may withhold or reverse referral credit obtained by abuse.
  • Launch offer. From 1 October 2026 to 31 October 2026 (both days included, South African time): (a) each customer’s first paid ad is free, for whichever duration they choose; and (b) every other paid ad and every renewal of a paid ad that customer places and pays for in that period costs 50% less than the normal price. Boosts and credit packs are not discounted. The first ad is counted per account and per cellphone number, so only one free first ad is given per person. The offer applies to ads placed and paid for in the offer period (an ad may run on after it ends), cannot be exchanged for cash, and cannot be combined with any other discount. Free and discounted ads must comply with these terms in the same way as other ads, and we may withdraw the benefit of the offer from anyone who abuses it, for example by opening several accounts.
  • An ad goes live automatically once payment is confirmed (or straight away when no payment is needed) and runs for the period chosen.
  • Each ad may include up to 5 photos and one document of up to 5 pages.
  • You may only advertise items or services you are lawfully entitled to sell, that are accurately described and not on the prohibited list.
  • You grant us a non-exclusive, royalty-free licence to display, resize and promote your ad content on the platform and in marketing of the platform, for as long as the ad runs.

5. Screening and removal

Ads are screened automatically before payment. We may refuse, hide or remove any ad that breaches these terms or the law, or that we reasonably believe is fraudulent, without a refund where the breach is yours. An ad reported by 3 or more users may be hidden while we review it.

6. Renewing and removing ads

You can renew an ad at any time from My ads. Days bought early are added to the current end date. You can remove an ad at any time and it comes down immediately. Unused days are not refunded when you remove an ad yourself.

7. Dealing with other users

Any transaction is solely between the buyer and the seller. You are responsible for checking the item, the other person’s identity and their right to sell, and for payment, transfer of ownership, delivery and any warranty. Sellers who trade in the ordinary course of business must comply with the Consumer Protection Act; second-hand goods dealers must comply with the Second-Hand Goods Act 6 of 2009.

8. What you may not do

  • Post false, misleading, duplicate or unlawful ads.
  • Copy, scrape or harvest ads or contact details, or use them for spam or marketing.
  • Harass, threaten or defraud anyone, or ask for OTPs, PINs or passwords.
  • Interfere with the platform’s security or operation.

9. Intellectual property

The SmousPlek name, logo, software and design belong to us. You keep ownership of your own photos and text and warrant that you have the right to use them.

11. Suspension

We may suspend or close an account that breaches these terms, after notice where it is reasonable to give it.

12. Complaints and disputes

Send complaints to info@smousplek.co.za. We aim to respond within 5 business days. If we cannot resolve it, you may approach the Consumer Goods and Services Ombud, the National Consumer Commission or a court with jurisdiction. South African law applies.

13. Changes

We may update these terms. The version in force when you pay applies to that ad. We will notify registered users of material changes by email.
